Hold Harmless Clause, Covenant Not To Sue And Release
This agreement made between the participant and North American Energy I, Inc. dba True Shot Gun Club, LLC is a COVENANT NOT TO SUE and RELEASE of all liability in consideration from the participant to True Shot Gun Club, LLC, jointly and severally for use of any shooting range, any instruction, observing, touring or visiting True Shot Gun Club and all its facilities, not limited to shooting in the desert, at another indoor or outdoor range, basically, anything you do with True Shot or its employees, affiliates, vendors, or anyone affiliated in anyway, by signing this agreement you agree not to sue, nor allow your heirs to sue should you become incapacitate or die.
Shooting with True Shot Gun Club, its employees, vendors, or affiliates is voluntary and by signing this agreement, the participant agrees to assume all liability for their actions and agrees to hold harmless True Shot Gun Club, LLC, its owners, employees and affiliates against any action arising from shooting with True Shot Gun Club at any range or outside. There is an inherent risk when handling firearms and/or entering a gun range, participant assumes all risks inherent to entering a gun range and facilities and the risks associated with shooting or being around firearms. Such risks could include but are not limited to; hearing damage, severe injury from improperly handling a firearm or even death. Firearms and/or ammunition can fail which can cause injury or death, participant recognizes the inherent risk of accident arising from manufacturing defects, freak accidents, negligence and any other cause of failure and accepts the sole liability for any and all issues that may arise.
Participant understands that should they have any questions at any time, they will ask a uniformed employee of True Shot Gun Club. Employees will do their best to make sure participants are safe at all times but cannot guarantee the safety of participants with regard to negligence on behalf of participant whether knowingly or accidental.
HOLD HARMLESS CLAUSE
Participant assumes any and all risks of injury or damage and releases True Shot Gun Club from any claim that its firearms, ammunition, gear, accessories, classes, and/or products of any kind caused damage to participants’ property or person. Further, participant agrees and understands that in using the shooting range and/or entering an event, instruction or touring the facilities whether owned by True Shot Gun Club, a third party, or shooting in the desert, that it will hold harmless True Shot Gun Club, LLC, its owners, employees and affiliates from any action and/or any liability arising from the use of True Shot Gun Club facilities and/or services including but not limited to damage, theft, loss or any injury however occurring while on True Shot Gun Club premises and/or property, or at a third party range or in the desert.
RELEASE
In addition to this Participant Agreement, Hold Harmless Clause and Covenant Not To Sue, the participant hereby releases and forever discharges True Shot Gun Club, LLC, its successors, and assignees from each and every right and claim which may arise now and forever on account of any injury, illness whether physical or mental, damages whether to person or property, or loss of any kind that may be sustained as a result of engaging in the use of the shooting range, instruction, event, class, observing, touring or visiting the True Shot Gun Club facilities and/or property, whether or not arising from the negligent acts or omission of True Shot Gun Club, its agents, employees, officers, directors, independent contractors, or volunteers. Furthermore, participant agrees to waive any and all rights to future actions against the company and forever discharge the True Shot Gun Club, LLC for any injuries, illness, damages to person or property as a result of any equipment, facility, weapon, gear, or ammunition malfunction or failure whether known or not known to me.
• Participant acknowledges that this is a contract and agrees that by signing this form, participant waived right from bringing any suit, claim, or action for damages now or in the future against True Shot Gun Club, LLC.
• Participant hereby recognizes that by signing this document they have read and understand and will abide by all RANGE SAFETY RULES and that failure to abide by these rules could result in temporary or permanent ejection from the range, facility and premises.
• By signing this agreement, participant agrees and accepts the all potential risks associated with being around firearms, whether known or unknown, that can include by are not limited to injury or death.
• I understand that I will not to shoot, watch, or participate in any way if I am pregnant and that in doing so could result in injury or death to fetus.
• True Shot Gun Club respects your privacy and does its best to safeguard any and all information from customers, but participant agrees to hold harmless True Shot Gun Club from any action arising from acts of cyber theft, hacking or physical theft of any and all records in the care and custody of True Shot Gun Club, and its affiliates and/or partners. We do require certain personal information should you choose to participate in any activity on our premises and to authenticate this waiver. We may need to contact you for necessary communication. (Example – to notify customer if they left the premises without their ID). We do send emails to our guests regarding information, notices, promotions, events, sales, etc. You may opt out of non-essential communication if desired. Your signature below gives consent to True Shot Gun Club to add to you to our mailing and electronic mailing lists. We do not sell customers information to third parties.
• By signing this document, I declare that I have read this entire document and understand the Hold Harmless, Covenant Not To Sue, and Release in its entirety and that all the information I have provided is true and accurate and that True Shot Gun Club can rely on the accuracy of the information.
• I attest that I am NOT a prohibited purchaser of firearms, ammunition or any other products that I may use with True Shot Gun Club.

PRIVACY

RANGE SAFETY RULES
1. Always treat all firearms as if they are loaded.
2. Never point a gun at something you are not willing to destroy.
3. Keep your finger off the trigger and outside the trigger guard until you are ready to fire.
4. Always keep firearms pointed down range, toward the backstop in a safe direction.
5. All firearms must be in their case or holstered while walking around. Firearms are only to be uncased or upholstered at the shooting table. NEVER handle firearms behind the firing line.
6. Never use alcohol or drugs before or while shooting
7. Always wash your hands after leaving the range to reduce/avoid consuming lead/lead dust
8. If you observe any unsafe behavior or condition, immediately report it to a True Shot Gun Club Employee/Range Safety Officer.
9. Eye and ear protection must be worn at all times. Never remove or adjust while on the range.
10. Always keep the action open and firearm unloaded until ready to fire.
11. It is your responsibility to ensure all firearms are in proper and working condition and safe to operate, know and understand how to property operate all firearms you intend to use and that you are familiar with all safety features.
12. Know and understand the operating mechanism and safety features of your firearm.
13. Only use the correct ammunition for your firearm.
14. All patrons will be held financially responsible for any damage they cause to True Shot Gun Club property, whether accidental, negligent or otherwise.
15. Upon the command “CEASE FIRE”, stop shooting immediately, put your firearm down in a safe manner and back away from the firing line and obey all commands from the Range Safety Officer. Do NOT approach the firing line or pick up your firearm until instructed to do so by the Range Safety Officer.
16. Range Safety Officers are to be obeyed at all times. Failure to do so can result in temporary or permanent removal from the range.
17. For any firearm or ammunition problem, keep the gun pointed down range with you finger off the trigger, do not set the gun down, signal a Range Safety Officer for assistance by raising your non-shooting hand.
18. Minors must be accompanied by a parent or legal guardian who stays with them at all times.
19. Shooters may collect their own brass behind the firing line.
Act responsibly and use a healthy dose of common sense at all times. Failure to abide by these rules or the commands of a Range Safety Officer may result in you and/or your party being temporarily or permanently dismissed from the range. Our goal is to ensure your safety at all times so if you have any questions, please ask a uniformed True Shot Gun Club employee.
I have read and understand all the Range Safety Rules and agree to abide by them and recognize failure to do so may cause me severe bodily harm, hearing loss, lead poisoning, or even death.
